Terms of Service
1. General
These Terms of Sale ("Terms") govern the sale of all photography services and digital/printed photos provided by Huck Productions ("we," "us," or "our"). By booking a session or purchasing photos from us, you ("client," "you," or "your") agree to these Terms. Please read them carefully before making a purchase or booking a session.
2. Booking and Payment
- Booking Fee: A non-refundable booking fee of 5% is required to secure your session date and time. The booking fee will be applied toward your total session cost.
- Payment: The remaining balance is due upon arrival of the session date. We accept payments via cash, check, Venmo, PayPal.
- Cancellation and Rescheduling: Cancellations made within 7 days before the scheduled session will result in the forfeiture of the booking fee. Rescheduling is permitted with 7 days notice, subject to availability.
3. Photography Session
- Session Time: The session will last for approximately one hour, unless agreed upon otherwise. Any delays caused by the client may result in a shortened session or additional charges.
- Location: Sessions will take place at the agreed-upon location. Any changes to the location must be communicated in advance and may incur additional travel fees.
- Client Responsibilities: The client is responsible for their own punctuality, attire, and any necessary preparations. Huck Productions is not responsible for missed opportunities or unsatisfactory photos due to client delays or lack of preparation.
4. Image Delivery and Usage
- Digital Files: Digital files are provided in high resolution and may be downloaded directly from a secure online gallery. The gallery will be available for 120 days for download. Extensions may incur additional fees.
- Usage Rights: The client receives personal usage rights for the digital files. Commercial use, resale, or reproduction of the images without written permission from Huck Productions is strictly prohibited.
- Photographer's Rights: Huck Productions retains the copyright to all images and may use them for promotional purposes, including social media, website, and portfolio, unless the client requests in writing that specific images remain private.
5. Refunds and Returns
- Session Fees: Session fees are non-refundable except in cases where Huck Productions cancels the session without offering a reschedule.
- Digital Files: Due to the nature of digital files, no refunds will be given once the files have been delivered.
6. Liability
Huck Productions is not liable for any loss or damage arising from the use of our services or images. In the event of a catastrophic incident (e.g., camera malfunction, theft, etc.), our liability is limited to a reshoot or refund of the session fee.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of West Monroe, Louisiana. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of West Monroe, Louisiana.
